Introduction

This document explains how Hardtank (HARD BEANS Sp. z o.o.) collects and processes personal data and uses cookies while you browse our website hardtank.com. Our goal is to ensure full transparency and compliance with the GDPR (Regulation (EU) 2016/679) and applicable Polish data protection laws.

1. Data Controller

2. Categories of Data and Collection Methods

Personal data are collected through: contact forms (Everest Forms, Pipedrive), newsletter and resource sign-ups (Klaviyo), webinar registrations, and cookies (Complianz). The data include: first name, last name, e-mail address, phone number, company name, country, message, industry sector, interests, and product inquiries.

Providing personal data is voluntary; however, in some cases, it is necessary to achieve specific purposes (e.g., responding to an inquiry or sending a newsletter). Failure to provide data may prevent us from carrying out these actions.

3. Purpose and Legal Basis

Data are processed for:

Responding to inquiries (Art. 6(1)(f) GDPR),
Contract performance and customer service (Art. 6(1)(b) GDPR),
Sending newsletters and marketing content (Art. 6(1)(a) GDPR – consent),
Website traffic analysis and optimization (Art. 6(1)(f) GDPR),
Sharing inquiries with local distributors with the user’s prior consent.

4. Data Retention

Personal data are retained for the period necessary to achieve the purpose for which they were collected and until consent to processing is withdrawn.

In particular:
– data from contact forms, newsletters, and inquiries – until consent is withdrawn or communication ends,
– marketing and analytics data – until consent is withdrawn; data in Google Analytics 4 are retained for 13 months,
– contact data originating from Apollo.io campaigns – stored solely for record-keeping purposes and marked as “Do not contact” if the user has not consented to further communication.

After these periods, the data are deleted or anonymised in a way that prevents user identification.

Data may be shared with our partners (distributors) only upon your consent. Data are also shared with entities providing hosting, analytics, and email marketing services (e.g., Cloudflare, Google, Hotjar, Klaviyo, Pipedrive). Data may be transferred outside the EEA (e.g., Google, Klaviyo) under EU Standard Contractual Clauses.

6. Automated Processing and Data Sources

As part of our marketing activities, we may conduct user profiling (e.g., segmentation in Klaviyo or behavioural analysis in Hotjar) to tailor communication content to user interests.
Such profiling does not result in decisions producing legal effects on the user.
Some contact data may originate from publicly available sources or commercial databases (e.g., Apollo.io). We process such data solely under our legitimate interest in contacting potential business partners.

7. Your Rights

You have the right to: access, rectify, delete, restrict processing, transfer your data, and object to processing. You can also withdraw your consent at any time by contacting: [email protected]. You also have the right to lodge a complaint with the President of the Personal Data Protection Office if you believe that the processing of your data violates the provisions of the GDPR.

8. Security

We implement technical and organizational measures to protect data against loss, unauthorized access, and disclosure, including encryption (SSL), Cloudflare protection, and reCAPTCHA.
Only authorized persons employed or cooperating with the controller have access to the data and are obliged to maintain confidentiality.
